Man beats his own father to death over will in Lagos state


An Ikeja Special Offenses Court on Monday condemned an expert, Rasak Abiona, to death for beating his 62-year-old dad to death with an iron pole during a disagreement about his will in Lagos. 

Equity Oluwatoyin Taiwo conveyed the judgment in a virtual hearing. 

Equity Taiwo held that however the indictment had introduced fortuitous proof against the moderately aged respondent during the preliminary, the state demonstrated its case past a sensible uncertainty. 

She noticed that the specialist's confession booth articulations to the police ensnared him and that during the preliminary, the respondent didn't present observers in court to back his case that his dad kicked the bucket after a fall. 

Equity Taiwo condemned Abiona subsequent to seeing him as liable of a charge of homicide in spite of Section 221 of the Criminal Law of Lagos 2011. 

Statement 

"This is an appalling and miserable situation where a child murdered his dad. There is no uncertainty that by hitting the perished with an iron bar on the head, the respondent proposed to cause offensive substantial mischief. 

"The litigant could have effectively overwhelmed his dad, a 62-year-elderly person without hitting him on the head with an iron pole. This case is an away from of what outrage and eagerness can do in a man's life. 

"The court doesn't have a prudence to give a lesser discipline for a situation of homicide considering Section 223 of the Criminal Law 2011. 

"I thus sentence the respondent to death for killing his dad, Sunday Abiona. This is the sentence of the court," 

the appointed authority said. 

Before the sentence was conveyed, the safeguard counsel, Mr Obinna Mbagho, in his request for leniency, asked the court to temper equity with kindness, taking note of that Rasak was a first-time guilty party who had demonstrated regret.

"He has been in jail since 2013 and since the time his detainment, his youngsters have been dissipated," 

Mbagho said. 

Contradicting the supplication for kindness, the examiner for the state, Mr Olakunle Ligali, mentioned for the greatest punishment for the wrongdoing. 

Statement 

"Under the Criminal Law of Lagos, when the wrongdoing has a definitive punishment of death, the court has no tact to moderate the sentence. 

"Indeed, the court doesn't have a tact to hear the supplication for kindness," 

Ligali said. 

As per the indictment, Rasak murdered his dad during a fight on February 28, 2012 at the expired's living arrangement at No. 22, Taiwo St., Ejigbo, Lagos. 

During the preliminary, five observers affirmed for the arraignment including the sibling of the expired, Mr Lanre Abiona and two relatives of the litigant, Ms Kafilat Abiona and Ms Shakirat Abiona. 

Other arraignment witnesses were a pathologist, Dr Moses Akpeniyi and the Investigating Police Officer (IPO), ASP Festus Omoru. 

The respondent didn't call any observer to affirm for him as affirmed exclusively with all due respect. 

Lanre in his proof had told the court that the litigant had a long history of beating his dad and that on one event, Rasak had beaten his dad to the degree his teeth had dropped out. 

Lanre noticed that he had told his late sibling on various events to abandon his child, yet he can't. 

Shakirat, during the preliminary told the court that the physical squabble between her sibling and father began in light of the fact that her sibling had gone to their dad's home needing to see a duplicate of his will, however their dad would not oblige his solicitation, prompting a battle between the men. 

The pathologist, in his declaration, had told the court that the expired had kicked the bucket from a mind discharge brought about by dull power injury brought about by an overwhelming article hitting the skull.
